26.1 Purpose

​​​a) The District Plan makes provision for designations in accordance with Sections 168 and 420 of the Act to give effect to notices of requirement made by Requiring Authorities. ​
b)​ Designations allow Re​​quiring Authorities to plan for network utilities and public works in relation to specific areas of land. Organisations that are Requiring Authorities are able to apply and use designations. The following organisations have status as Requiring Authorities.​
i.​ A Minister of the Crown.​
ii.​ A Local Authority.​
iii. A network utility operator approved as a Requiring Authority under Section 167 of the Act.​
c)​ Status as a Requiring Authority provides the power to require land, including private land, to be set aside for designated activities for which works can be undertaken and for which the Requiring Authority is financially responsible.​
d) As set out in section 176 of the Act, a designation has two main purposes.​
i.​ Firstly, the Requiring Authority responsible for the designation may do anything that is in accordance with the designation. These rights over-ride District Plan provisions, meaning that Requiring Authorities do not need to obtain land-use consents in accordance with District Plan rules as long as the proposed works are in accordance with the purpose of the designation.​
ii.​ Secondly, a designation protects the land for the Requiring Authority.  Other people may not, without the written approval of the Requiring Authority, do anything in relation to the designated land that would prevent or hinder the project or work to which the designation relates.​
e)​ All designated land has an underlying zoning which applies when a designation is removed or for works not covered by the designation.​
